KINTSUGI YOGA MAY MAKE AVAILABLE OTHER SERVICES (“THIRD-PARTY SERVICES”) ADMINISTERED BY A THIRD-PARTY (“THIRD-PARTY SERVICE PROVIDER”). YOUR USE AND ACCESS OF THIRD-PARTY SERVICES ARE GOVERNED BY THE THIRD-PARTY SERVICE PROVIDER’S PRIVACY POLICY AND TERMS OF SERVICE.

These Terms are subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms will be in effect as of the “Last Updated Date” and accessible via THE KINTSUGI YOGA TERMS AND CONDITIONS OF SALE. The KINTSUGI YOGA RISK ACKNOWLEDGEMENT RELEASE AND LIABILITY WAIVER FORM is also subject to change, and you are responsible for reviewing those terms periodically. Your continued use of the Service will constitute your acceptance of and agreement to all such changes.

 

  1. ORDER ACCEPTANCE/CONFIRMATION. You agree that your order is an offer to buy under these Terms.Kintsugi Yoga reserves the right to accept or reject orders in its sole discretion.

 

  1. SERVICES. Kintsugi Yoga’s offers onsite yoga retreats (Yoga Retreats), onsite (in-person) yoga classes/guided mediations other than those offered in connection with a yoga retreat (Onsite Services), online yoga classes/guided meditations (Online Programs), collectively referred to herein as Services or Programs. Please note that in connection with the Services or Programs provided herein, schedules provided are estimates. All times, classes, workshops, experiences, activities, excursions, and locations are subject to change. All workshops, activities, excursions, yoga classes, meditation classes are optional, and you are encouraged and empowered to participate or not as you desire.

 

  1. PRICING/PAYMENT.
    1. US Dollars. All prices are in US dollars.

 

  1. Prices Subject to Change. All posted or advertised prices posted are subject to change without notice. The price charged for the Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your order total (as applicable) and will be itemized in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer made by us and we reserve the right to cancel any orders arising from such errors.

 

  1. Payment Terms; Method. Terms of payment are within Kintsugi Yoga’s sole discretion and are currently processed via STRIPE. Payment processing is governed by the STRIPE’S terms and conditions and privacy policies, available at Payment Terms (stripe.com). Full payment is due at time of registration and can be made with Visa, MasterCard, American Express, or Discover. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

 

  1. Cancellations and Refunds. All registrations and bookings are subject to Kintsugi Yoga’s cancellation policies listed below. PLEASE REVIEW THE SPECIFIC CANCELLATION AND REFUND POLICIES FOR EACH SERVICE DESCRIBED BELOW:
    1. Yoga Retreats. For Yoga Retreats, a $500 deposit is non-refundable and secures your spot on the retreat. Full retreat payments are due no later than 75 days before the retreat. If you need to cancel more than 6 months prior to a retreat start, no refunds will be issued. If the retreat needs to be cancelled for unforeseen circumstances by Kintsugi Yoga, your deposit and payment will be fully refunded. No refund is available if you do not show up, leave a retreat, event, or accommodation early, if you arrive at the retreat location with symptoms of active infection, or leave early if you test positive for Covid-19 during the retreat.

 

  1. Onsite (In-Person) Yoga Classes and Guided Meditations (Onsite Services). Your deposit for Onsite Services is non-refundable and secures your spot. Full payment is due no later than 75 days before the session start date. If you need to cancel more than 75 days before the session start date, you will be refunded your payment, excluding the non-refundable deposit amount. If you cancel in less than 75 days before the session start date, no refunds will be issued. In the event the session needs to be cancelled for unforeseen circumstances by Kintsugi Yoga, your deposit and payment will be fully refunded.

 

  1. Online Yoga Classes and Guided Meditations (Online Programs). No refunds or credits are available for any Online Programs.

 

  1. Other Cancellations. No other refunds or credits are available. Kintsugi Yoga’s standard cancellation policy applies to all other charges. Please note that cancellation of program involvement also includes any dismissal by Kintsugi Yoga administration due to violations of these terms or any other related agreements or policies. KINTSUGI YOGA RESERVES THE RIGHT TO CANCEL ANY SERVICE OR PROGRAM AT ANY TIME. IN THIS EVENT, YOU WILL BE GIVEN A COMPLETE REFUND OR CREDIT (AT OUR DISCRETION). ANY REFUND GRANTED WILL BE CREDITED BACK TO THE ORIGINAL PAYMENT METHOD OR CARD; AND ANY CREDITS GRANTED AT THE DISCRETION OF KINTSUGI YOGA WILL BE APPLIED TO YOUR KINTSUGI YOGA ACCOUNT AND WILL REMAIN VALID FOR A PERIOD OF 12 MONTHS FROM THE DATE OF CANCELLATION.

 

  1. PARTICIPANT RESPONSIBILITIES. For Yoga Retreats and Onsite Services, you are responsible for transportation to and from Yoga Retreat location or other Onsite location, and any additional costs related to your attendance (e.g., excluded meals, excluded activities, etc.) unless expressly included in the specific Yoga Retreat or other Service package.  You are encouraged to obtain travel insurance for your Yoga Retreat.

 

  1. RELEASE OF LIABILITY. You hereby release Kintsugi Yoga from any and all liability arising out of or related to Services or Programs provided byKintsugi Yoga.

 

  1. WAIVER. You hereby waive and releaseKintsugi Yoga from any and all liability arising out of or related to your participation in the Services or Programs. You hereby acknowledge and agree that you are participating in the Services, Programs, and any Third-Party services at your own risk.

 

  1. ASSUMPTION OF RISK. You hereby acknowledge and agree that you are aware of the risks associated with the Services, Programs, and Third-Party Services and agree to assume the risks associated with such participation.

 

  1. INDEMNIFICATION. You hereby agree to indemnify and hold harmless Kintsugi Yoga from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your participation in the Services and Programs.

 

  1. WEBSITE PRIVACY STATEMENT. We understand the importance of protecting your privacy while online. This privacy statement explains the data collection and use practices of our website. We collect personally identifiable information from you when you register for our Services or Programs. This information may include your name, email address, and payment information. We may also collect non-personally identifiable information, such as your IP address, browser type, and operating system. We use the personally identifiable information you provide to process your orders, respond to your inquiries, and provide customer service. We may also use your information to personalize your experience.

 

  1. PHOTO RELEASE.  You give permission for Kintsugi Yoga LLC to use images (including still and video) of you taken during Yoga Retreats, Onsite Services, or Online Programs without recourse to you and without compensation to you, for publicity and promotion purposes only through whatever medium it chooses.

 

  1. SEVERABILITY. If any of the term set forth herein is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining terms and provisions shall remain in full force and effect.


GOVERNING LAW. These terms and conditions shall be governed by the laws of the State of Colorado.
